Support in the implementation of NPPS (National Public Procurement Strategy), by strengthening the administrative capacity of NAPP (National Agency for Public Procurement) and contracting authorities, SIPOCA Code 625

Purpose: supporting the implementation of NPPS, by strengthening the administrative capacity of NAPP and contracting authorities. The objective is to increase transparency and responsibility of the public procurement system, for a unitary application of public procurement rules/procedures and fewer irregularities in this field.
The Specific Objectives of the project are:
- Improving the public procurement system by assessing the impact of NPPS implementation and elaborating a public procurement Action Plan;
- Strengthening the capacity of NAPP in order to consolidate the new way of performing ex-ante control. Support at the sectoral level is needed, with the implication of experts who can offer assistance to NAPP staff. This assistance consists in verifying both award documentation and the technical specifications within the award documentation specific to the IT field – the selected pilot area;
- Streamlining the internal working practices of NAPP, by developing an electronic application for legislative screening. The objective is to ensure transparency in the process of public consultation of normative acts (legislation) draft/working tools initiated by NAPP, which will lead to less bureaucracy;
- Facilitating the effective monitoring of the public procurement market, in order to fulfill the favorable condition according to the Government Memorandum. This Memorandum, “Elements regarding the national preliminary position on the legislative package on Cohesion Policy 2021-2027”, was approved in September 2018.
- Professionalization of the staff involved in the public procurement field, by strengthening the normative and institutional framework for the development of their career, abilities and knowledge.
- Encouraging the aggregation of demand between local contracting authorities, by creating at least two pilot units of centralized procurement at the local level. The aim is to streamline the use of public funds and disseminate the importance and benefits of establishing local UCA;
- Developing the capacity of contracting authorities in the field of public procurement by supporting 160 contracting authorities in order to improve the process of preparation and management of public procurement procedures. Thus, fewer irregularities and financial corrections will result;
- Unitary application of public procurement rules and procedures and reducing irregularities in this field, by organizing specialized training and improvement programs in the field of public procurement. Therefore, efficient use of public money is expected.
The main expected results of the project are:
- An evaluation analysis of the public procurement system in Romania, following the implementation of NPPS measures. The action directions that will be taken by NAPP or other actors of the public procurement system must be identified, in order to improve the national system by developing an Action Plan in the field of public procurement;
- Strengthening the normative and institutional framework for the development of the career, abilities and knowledge of the staff involved in the field of public procurement (in partnership with INA)
- The occupational standard “public procurement expert” will be revised;
- A competency framework for the public functions of ”public procurement advisor” and ”public procurement system advisor”, will be elaborated;
- A study regarding the introduction of a regulated profession in the field of public procurement, as well as the development of an award system;
- A program of specialized training and improvement in the field of public procurement, for 4100 persons (at central and local level) will be created.
- Establishing three pilot units of centralized procurement at local level (county, municipality and IDAI) by developing configuration and organization models to be used by other public authorities at the national level. Thus, efficient centralized procurement will be achieved, determining less irregularities and financial corrections. Organizing 16 information conferences at the regional level is also part of the plan.
- Providing on-the-job support for 160 contracting authorities in collaboration with the World Bank. The selected authorities will be supported in elaborating the award documentations for three procedures (supply, services and work), and also in signing and implementing contracts;
- Providing support by the BEI experts for ex-ante control. NAPP will continue the process of strengthening the ex-ante control, in order to be in line with the National Public Procurement Strategy (NPPS). This assistance represents the transfer expertise from the sector experts to ex-ante controllers in order to obtain a substantial and unitary approach to the qualitative verifications performed;
- Developing two IT applications at the NAPP level – one for legislative screening and one for ensuring transparency of normative acts’ drafts.
- Creating an effective mechanism that could provide relevant information for monitoring the public procurement market. Moreover, the types of existing data will be analyzed in order to establish a strategy for their collection and integration. A permanent, updated analysis of the indicators at the level of system, sector or contracting authority, will thus be possible.
